Where the Lindsay Clancy case stands

Updated Oct 4, 2026

Lindsay Clancy is charged with three counts of first-degree murder in the January 2023 deaths of her children, Cora, 5, Dawson, 3, and Callan, 8 months, at the family home in Duxbury, Massachusetts. The defense has never disputed that she caused their deaths. Its case is that she was not criminally responsible because of postpartum psychosis.

Her trial in Plymouth Superior Court ended without a verdict. Closing arguments were heard on August 27, 2026; after seven days of deliberation the jury told Judge William Sullivan three times that it was hopelessly deadlocked, and on September 4 he declared a mistrial. Several jurors and the defense have said the panel split 11 to 1 in favour of finding her not criminally responsible. CBS News later reported that the lone holdout had faced a domestic violence charge in 2021 that was dismissed; whether he answered the juror questionnaire truthfully is a question only a court inquiry could settle, and the questionnaires are sealed.

District Attorney Timothy Cruz has not said whether the state will retry her. Clancy has hired Martin Weinberg, one of Karen Read's trial lawyers, who has said he will fight a retrial. At a motions hearing on September 29 the defense asked the court to enter a finding of not guilty by reason of lack of criminal responsibility, argued that a second trial would amount to double jeopardy, and sought records from the jurors' phones. No ruling was made that day. Her former husband, Patrick Clancy, who testified at trial that he has forgiven her, gave his first interview since the mistrial to 60 Minutes on September 20.

The case is filed under Heartbreaking, a register that describes the loss of three children. It is unresolved, no verdict has been returned, and Clancy is presumed innocent of the charges.
